These Terms of Service (“Terms”) govern your use of thepackdaddies.com (“Website”) and purchases made directly through the Website. Please read them before placing an order. By purchasing from us, you agree to the terms applicable to your order, subject always to your statutory rights.

The Pack Daddies is a UK-based trading card retailer offering Magic: The Gathering and other trading card games, sealed products, collectables, accessories and merchandise.

The address above is the returns and correspondence address we currently provide. If our legal registered office or principal business address differs, the correct details will also be made available as required by law.

2. Scope of these Terms

These Terms apply to purchases made through this Website. Orders made through Whatnot, other marketplaces or third-party services may also be subject to those platforms' separate terms and checkout arrangements. Any statutory rights you have against the actual seller remain unaffected.

Nothing in these Terms takes away rights provided to consumers by applicable law.

3. Products, descriptions and condition

We aim to describe products accurately, including the relevant set, product type, quantity, language, condition and whether the item is sealed, where applicable. Product photos are provided to help identify the item; minor packaging artwork or manufacturing variations may occur, but the goods supplied must still match their description.

Where an item is offered as a single trading card, its stated condition or grading is part of the product description. Please read the listing carefully before ordering. If you need clarification about a listing, email us before checkout.

Manufacturer trademarks and product names belong to their respective owners. Their appearance on this Website does not imply endorsement or affiliation unless expressly stated.

4. Randomised packs and collectable value

Booster packs, booster boxes, bundles and similar products generally contain randomised cards determined by their manufacturer. Unless expressly stated in a listing, we do not guarantee a particular card, rarity, treatment, pull rate, grade or secondary-market value.

Buying and opening packs does not guarantee a financial return or a specific outcome. A disappointing pull or a subsequent change in a product's market price is not, by itself, evidence that the product is faulty. These statements do not affect your rights if the product is faulty, counterfeit, misdescribed or otherwise fails to meet the legal requirements of the contract.

5. Placing an order

Before you submit an order, you will have the opportunity to review your basket, delivery details and the charges displayed at checkout. Please check them carefully.

After checkout, we will send an electronic acknowledgement to the email address provided. An acknowledgement confirms receipt of the order and does not necessarily mean we have accepted it. We may decline or cancel an order before acceptance where, for example, an item is unavailable, payment cannot be verified, or a clear and genuine listing error has occurred. If we have taken payment for goods we cannot supply, we will refund the amount paid for those goods and any associated delivery charge that is no longer applicable.

We will confirm acceptance when we dispatch the order or otherwise expressly confirm acceptance. For pre-orders, we may confirm acceptance earlier, as indicated in the checkout or order communications. Once a contract is formed, your statutory rights apply.

6. Prices, VAT and payment

Prices on the Website are displayed in pounds sterling (GBP), including applicable UK VAT where required. Available payment methods and the full order total, including delivery charges, are shown at checkout before you commit to pay. International orders may attract customs charges, import VAT or duties payable under the applicable destination-country rules; any such charges not collected at checkout will be explained where required by law.

We may change prices for future orders. Price changes will not retrospectively alter an order we have accepted. If a material price or product information error is identified before acceptance, we will contact you or cancel and refund the affected order rather than charge a different price without your agreement.

Payments are processed through the payment services made available at checkout. Please do not send payment-card details to us by email.

7. Stock availability and fulfilment

We make reasonable efforts to keep product availability accurate, but placing an item in your basket does not reserve it. If an item becomes unavailable after your order is placed, we will contact you about the options available, including a refund of the unavailable item. We will not substitute a materially different product without your agreement.

Order quantities may be limited where clearly stated in a product listing or promotion. Any changes will be handled fairly and in accordance with applicable law.

8. Pre-orders and release dates

Products labelled as “pre-order” are offered before their expected release or stock-arrival date. Any stated release or dispatch date is based on information available when the listing is created and may change because of manufacturers, distributors or transport arrangements. We will communicate material delays where reasonably possible.

You may cancel a pre-order for a full refund at any time before dispatch. If we cannot fulfil a pre-order, we will refund the affected product in full. Where applicable, you retain statutory rights concerning delivery delays, cancellation and non-conforming goods.

If an order contains both in-stock and pre-order items, they may be dispatched together unless separate dispatch has been arranged; any relevant delivery information should be made clear before checkout. See our Shipping & Delivery information.

9. Delivery and risk

Available shipping methods, destinations, delivery charges and any stated delivery estimates are shown during checkout or on the relevant product page. For sealed TCG products in our standard UK shipping profile, delivery is currently £5.99 on eligible orders below £200 and free at £200 or above. These prices or thresholds may change for future orders; the confirmed checkout charge applies.

Merchandise fulfilled by print-on-demand or other partners may be shipped separately and may incur separate delivery charges, including in mixed baskets. Please review the charges at checkout.

Unless we have agreed a different delivery period with you, we will deliver the goods without undue delay and in any event within 30 days of the contract being made, as required by law. If there is a significant delivery problem, contact us so that we can resolve it and provide any remedy to which you are entitled.

For consumer orders, responsibility for the goods generally remains with us until you, or a person you nominate other than the delivery carrier, take physical possession of them. Please ensure your delivery address and contact details are accurate, and contact us promptly if you notice an error.

10. Cancellations, returns and refunds

Our Returns & Refunds Policy explains how to cancel orders, return goods, report damage or faults and request a refund. This policy forms part of the information relevant to your purchase and should be read alongside these Terms.

For most eligible online consumer purchases, you have the right to cancel without giving a reason within 14 days after receiving the goods, or after receiving the final item where applicable. You then generally have a further 14 days to return them. For a change-of-mind cancellation, you ordinarily pay the direct cost of return postage if informed of that obligation.

We ask that factory-sealed products be returned unopened where possible. Opening sealed trading card products can substantially reduce their resale value, and, where the law permits, we may make a proportionate deduction for handling beyond what is reasonably necessary to inspect the goods. Opening a pack does not automatically extinguish statutory cancellation rights. Any deduction must reflect the actual loss in value and will not be an automatic penalty.

We do not offer an additional voluntary change-of-mind return right for opened booster packs, boxes or other opened sealed TCG products beyond statutory requirements. Refunds of qualifying statutory cancellations will be handled within the legal deadlines, including eligible standard outbound delivery costs.

To exercise a cancellation right, email info@thepackdaddies.com with a clear statement that you wish to cancel. You do not need our approval or a particular form to exercise statutory rights.

11. Faulty, damaged, counterfeit or incorrect goods

Goods must be as described, of satisfactory quality and fit for purpose as required by the Consumer Rights Act 2015. Where goods are faulty, damaged in delivery, incorrectly supplied, counterfeit or otherwise do not conform to the contract, you may be entitled to a refund, repair, replacement or another legally required remedy.

Consumers generally have a short-term right to reject qualifying faulty goods within 30 days, with additional statutory remedies potentially applying thereafter. We will pay reasonable return costs where required by law.

We may ask for reasonable supporting information, such as order details, photographs, or an opportunity to inspect the item, to help investigate an issue. We do not require a particular photograph, video, verification code or report within 24 or 48 hours as an automatic precondition of a valid statutory claim. 12. Merchandise and third-party fulfilment

Some clothing or merchandise products may be made or dispatched by fulfilment partners. The supplier, production method and dispatch location may differ from our sealed trading card shipments, and delivery may take place in more than one parcel. This does not remove our responsibility as the seller for Website purchases or limit your applicable consumer rights.

Where merchandise is personalised or made to your specifications, any statutory cancellation exception will only apply where the relevant legal requirements are met and the product listing makes the necessary information clear.

13. Promotions, referrals and third-party services

Discounts and promotions are subject to the specific eligibility rules, expiry dates and other material conditions presented with each offer. We may correct obvious errors or withdraw promotions for future purchases, but will not retrospectively remove a discount from an accepted order without a lawful basis.

Our Website may link to Whatnot and other independent services. Referral credits, including any new-buyer sign-up incentive, are provided and governed by the third-party operator's current offer terms. Eligibility, credit amounts and redemption rules may change. An external referral offer is not a discount on an order placed directly through this Website unless we expressly state otherwise.

External websites and platforms operate under their own terms and privacy notices. We do not control their availability or their independent offers.

14. Website use and intellectual property

You may use the Website for lawful personal shopping and browsing. You must not attempt to disrupt the Website, access another person's account without permission, submit fraudulent orders or knowingly provide misleading information.

Our original Website design, copy and branding remain our intellectual property or are used with permission. You may not reproduce them commercially without permission. Nothing here prevents lawful use of product names, legitimate reviews or rights you otherwise have under law.

15. Liability and your statutory rights

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of that failure or our failure to use reasonable care and skill, subject to applicable law. We are not liable for loss or damage that was not foreseeable or that is unrelated to a breach by us.

We supply products for personal use unless a different purpose is expressly agreed. These Terms do not exclude any responsibility we would otherwise have under consumer law, including for goods that are not as described or that fail to meet the required standards.

16. Privacy and data protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection law. Shopify and payment providers may process personal information as part of delivering the checkout and payment services.

17. Changes to these Terms

We may update these Terms for future use, for example to reflect changes to our products, fulfilment methods or legal obligations. The version applicable to an accepted order is generally the version provided to you when that order was placed, unless a subsequent change is required by law or is expressly agreed with you.

18. Applicable law and disputes

These Terms will be interpreted in accordance with the law applicable to your transaction. Nothing in them prevents a consumer from relying on mandatory consumer protection rules or from bringing proceedings in a court that has jurisdiction under applicable law.
